General Terms and Conditions of the Deutsches Theater München
§ 1 Scope of application
1.1 The terms and conditions of use govern legal relationships between the Deutsches Theater München Betriebs-GmbH (hereinafter referred to as the “Theatre”) and individual customers, resellers, companies and group customers (hereinafter referred to as “customers”). For legal transactions between the Theatre and the customers, only the following general terms and conditions of business (hereinafter referred to as “GTC”) apply in their current version. The Theatre does not recognize deviating conditions unless it expressly agrees to their validity.
1.2 Resellers undertake to notify the following terms and conditions to each buyer when purchasing a ticket.
§ 2 Formations of a contract / ticket purchase / shipping
2.1 Ticket sales between the Theatre and the visitor come about through the customer’s order and acceptance thereof by the Theatre. Tickets can be purchased at the Theatre box office, associated ticket offices as well as in writing, by phone or on the internet. If the order is placed in writing, by telephone or over the Internet, the customer receives a booking number, which is communicated to him orally, by telephone or in writing.
2.2 For the ball season, the Theatre – with the exception of its own events – only works as a ticket office for third-party organisers. Direct contractual relationships relating to the event are thus only established between the respective organiser and the customer.
2.3 Right of revocation
You have the right to revoke the contract for the purchase of voucher(s) or goods within 14 days without giving any reasons.
The period of revocation is 14 days from the date on which you or a third party named by you, who is not the promoter, comes into possession of the voucher(s) or goods.
In order to exercise your right of revocation, you must contact us, Deutsches Theater München Betriebs-GmbH, Schwanthalerstraße 13 Aufgang II, 80336 Munich, Tel. (089) 55 234-0, Fax +49 (0) 89 55 234-101, Email: vertrieb(at)deutsches-theater.de, by means of a clear statement (e.g. a letter sent via mail, a fax or an email) of your decision to cancel this contract. If you make use of this option, we will send you a confirmation of receipt of such a revocation immediately (e.g. by email).
To meet the cancellation deadline, it is sufficient for you to send your communication regarding your exercise of the right of cancellation before the cancellation period expires.
Consequences of cancellation
If you cancel this contract, we are obligated to reimburse you for all payments we received from you, including the cost of delivery (except for additional costs resulting from your having chosen a different type of delivery than the standard delivery offered by us) immediately and no later than within a period of 14 days from the date on which we receive the notice of your cancellation of the contract. For this repayment, we use the same means of payment that you used in the original transaction, unless expressly agreed otherwise with you; under no circumstances will you be charged any fees for this repayment. We can refuse repayment until we have received the voucher(s) or goods back or until you have provided proof that you have sent back the voucher(s) or goods, whichever is the earlier. You have to send back or hand over the voucher(s) or goods immediately and in any case within 14 days from the day on which you inform us of the cancellation of this contract. The deadline is met if you ship the voucher(s) or goods before the deadline of 14 days. You only bear the direct costs of returning the voucher(s) or goods. You only have to pay for any loss in value of the voucher(s) or the goods if this loss in value is due to handling of the goods that is not necessary for checking their nature, properties and functionality.
2.4 The customer purchases the tickets in his/her own name and for his/her own account. If the customer resells tickets, any representation of the Theatre is excluded.
2.5 Unless otherwise agreed, tickets will be sent to the customer by mail at his/her risk after the full payment has been received. The purchase price including all fees will be communicated to the customer verbally, by telephone, in writing or by email.
2.6 The Theatre is entitled to charge a processing fee for orders placed by telephone, in writing or for group sales. This fee also applies to self-collection. The Theatre is entitled to charge an internet fee for orders placed over the internet. Processing and internet fees include the shipping costs and are to be paid together with the purchase price.
2.7 If the customer has been given an option to purchase tickets, this will expire without replacement if the customer does not take advantage of it within the agreed period.
2.8 Tickets deposited for self-collection must be collected no later than 30 minutes before the respecctive performance begins, stating the booking number.
2.9 The ticket loses its validity when you leave the event location.
2.10 Please note regarding the Print@home procedure that the Print@home ticket may only be printed out once and may not be reproduced or changed. In the event that copies of this Print@home ticket appear, only the owner who appears first at the entrance will be admitted to the event. Furthermore, the Theatre reserves the right to request payment from the ticket purchaser whose ticket has been illegally reproduced due to his/her own fault to pay the total value of the reproduced Print@home tickets.
The theater bears no responsibility for loss and/or misuse of the ticket.
§ 3 General information on ticket sales via the internet
3.1 The complete internet web shop including fulfillment and payment processing is operated by München Ticket GmbH, Seidlstr. 30, 80335 Munich, in the name and for the account of the Theatre. Contractual relationships only arise between the ticket buyer and the Theatre.
3.2 The ticket buyer has to register with the Theatre to buy tickets online. The ticket buyer assigns his/her password himself/herself. The password and the other customer data can be changed in the customer account by the ticket buyer at any time. The Theatrerecommends changing the password at regular intervals.
The ticket buyer is responsible for ensuring that no unauthorized third parties gain knowledge of his/her password. The ticket buyer is liable for any culpable misuse caused by him/her.
3.3 The ordering process is as follows:
3.3.1 Before or after registration, the ticket buyer can choose the seats he/she wants – if they are still available – via a so-called “best seat option” (the best available seats are suggested by the system) or manually via the seating plan.
If reduced prices are offered and the requirements are met by the ticket buyer, he/she can then choose a reduced price.
3.3.2 The ticket buyer can then choose the desired delivery / shipping method (shipping, collection or Print@home) as well as the payment method.
3.3.3 After the ticket buyer has accepted the general terms and conditions, the order is displayed again in an overview and must be confirmed by him/her. It is possible to change all data here once more.
3.3.4 After confirming the data, the order is confirmed, and the confirmation is also sent to the ticket buyer by email to the email address he/she has provided.
3.3.5 Ticket purchases via the internet are limited to 19 tickets per order. The Theatre reserves the right to adjust the number of tickets per order for certain events. The Theatre also reserves the right to limit the number of tickets that can be ordered per ticket buyer and to cancel any additional orders from individual ticket buyers.
§ 4 Due date and payment / retention of title / delay
4.1 The purchase price is due for payment upon confirmation of the order with allocation of an individual booking number. Unless otherwise agreed, payments can be made by bank transfer, direct debit, cash or credit card.
4.2 Tickets remain the property of the Theatre until full payment has been made. If a payment is debited back, the customer is obliged to return the tickets immediately and to reimburse the costs incurred by the debit. Reserved tickets that are not paid in time will be released for sale after the payment deadline.
4.3 In the event of late payment, the Theatre is entitled to interest of 5% p.a. above the respective base rate of the Deutsche Bundesbank, unless the Theatre proves the charge with a higher rate or the customer proves the charge with a lower rate. This does not exclude the assertion of further damage.
§ 5 Start / admission
5.1 The Theatre usually opens one hour before the performance begins.
5.2 After the start of a performance, visitors can only be let into the auditorium during a suitable break in consideration of the participating artists and the other visitors.
5.3 There is no entitlement to an intermission.
§ 6 Changes of line-up / performance times
The Theatre reserves the right to change the announced casting of roles and the performance times at short notice for imparative reasons.
§ 7 Return and exchange of tickets / loss of tickets
7.1 A return or exchange of tickets is cardinally excluded.
7.2 In the event of a cancellation of performance, the Theatre offers the customer the exchange for an equivalent ticket for another performance of his/her choice within the same series of events, or reimburses the purchase price upon return of the ticket. The request for an exchange or return must be submitted to the Theatre immediately, at the latest within five working days after the cancelled performance. Otherwise the claim expires. Further claims by the customer (e.g. travel / accommodation expenses) are excluded.
7.3 If the performance is cut short, the entrance fee will only be refunded if half of the performance has not yet run. A claim for reimbursement must be communicated to the Theatre in writing within five days at the latest.
7.4 It is not permitted to take a seat other than the one stated on the admission ticket. In the event of an unauthorized change of seat, the difference in price can be raised or the visitor can be expelled from this seat or from the performance.
7.5 A refund of the purchase price or the delivery of replacement cards in the event of loss of tickets is excluded.
7.6 Any reimbursement of advance booking or other fees is the responsibility of the respective reseller.
7.7 The tickets lose their validity after the start of the event.
§ 8 Reduced admission prices
8.1 Discounts are granted by the Theatre depending on the respective series of events. The discounts applicable for the performance are to be requested at the Theatre box office or the telephone advance booking.
8.2 For all discounted tickets, the Theatre requires valid proof of appropriate authorisation before admission. The identity of the beneficiary must be proven in a document with photo identification. If no proof can be provided, the difference to the full ticket price must be paid. Otherwise admission cannot be granted.
8.3 The simultaneous granting of several discounts per ticket is excluded.
8.4 For discount tickets, the discount level as well as the number of tickets per booker specified in the menu item “Discounts” on the website of the Deutsches Theater apply. The ticket holder is considered the booker. If the booker is granted a price advantage based on the submission of the ticket, no further price advantage can be added.
8.5 Discounts can no longer be taken into account once the booking process has been completed.
§ 9 Sound, film, photo and video recordings
9.1 At the venue, sound, film, photo and video recordings are prohibited for copyright reasons. Recording devices and cameras of all kinds must be checked in at the cloakroom for storage for a fee.
9.2 In the event of violations, the house staff is entitled to confiscate recording devices and cameras and to withhold them until the end of the event. Films and recording materials of any kind on which parts of the performance are recorded can be confiscated and detained by the organiser. They will be returned to the owner if the owner has agreed to the deletion of the recordings.
9.3 By purchasing the ticket, visitors to the Theatre declare their consent to the Theatre taking photos and filming as part of the event and to reproduce and publish the recordings without any time or space restrictions. The consent is given expressly by waiving a right to remuneration.
§ 10 House rights / House rules
10.1 While at the Deutsches Theater
Every visitor has to behave in such a way that no other person is endangered, impeded, harmed, threatened or harassed.
Unauthorized persons are not permitted to stay on the premises.
The following persons are authorised:
1. Persons visiting an event with a valid entrance ticket
2. Persons buying tickets at the day or evening box office
3. People visiting on an organised tour
4. Government agency representatives performing official duties
5. Artists and cast members, with prior registration
6. Suppliers with prior registration
7. Employees of Deutsches Theater München Betriebs GmbH
8. Employees of companies working in the same building
Access to the stage, backstage, cloakroom, rehearsal and storage areas is permitted only for persons with a valid ID. Presence on the stage is only permitted as long as it is necessary.
The instructions of the staff must be followed. In the case of non-compliance, a house ban may be issued. Persons who do not leave the premises despite the staff’s instructions to do so, will be charged with trespassing. Persons who have been banned from the house are not allowed to enter the Theatre.
Furthermore, people who are drunk or under the influence of drugs can be denied access despite having a valid ticket or identity card. People who are not dressed appropriately can be denied entry despite having a valid ticket.
10.2 General
Without permission from the Directorship of the Theatre, it is not permitted to do the following on the entire premises:
1. To sell tickets (“black market”)
2. To sell goods, food or beverages
3. To make music
4. To distribute printed material
5. To advertise or ask for collections/donations
6. To film or take photographs
7. To park vehicles
There is a statutory ban on smoking (Art. 2 No. 6 GSG) in all the rooms of the Theatre.
Evacuation routes and emergency exits are to be kept free at all times.
Consumption of food and drinks brought from outside the premises is not permitted in the auditorium (foyer incl. lounge, Theatre hall, bar areas, silver hall) and hallways.
Pets are not allowed in the Theatre hall.
Fire authorities require that visitors surrender their belongings at the visitors’ cloakroom. This specifically includes jackets, coats, umbrellas, bags (except handbags), backpacks, prams, large or bulky items of luggage and musical instruments.
The Theatre accepts no liability for personal belongings and valuables that are kept outside of the visitors’ cloakroom.
Lost property will be left on the stage entrance.
10.3 Disturbance of the peace (in the Theatre)
Significant violations of the house rules generally lead to a warning and in serious cases to a house ban. These include, in particular:
– Bringing and using drugs
– Bringing and drinking alcohol outside the defined catering areas
– Bringing or using weapons and other dangerous objects
– The threat or commission of physical violence
– Deliberate damage of property
– Theft
– Rioting
– Swearing at or insulting the staff of the Theatre or staff of other companies working in the same house, or visitors thereof
– Defilement of the house and grounds
– Begging
10.4 Miscellaneous provisions
For visitors, the general terms and conditions apply.
The events of the Theatre are generally open to children from the age of 6 years and up. Enquiries for changes regarding individual productions are to be made at the Theatre box office or booking offices.
Tenants and business partners must adhere to the concluded contracts.
The house rules apply with immediate effect.
The house rules of the Theatre are publicly announced and must be adhered to at all times. The instructions of the employees of the Theatre, as well as of the attendant entry control services, must be followed.
§ 11 Cloakroom
11.1 Coats, umbrellas, walking sticks, large bags and similar items must be surrendered at the cloakroom for storage at a fee.
11.2 The loss of or damage to cloakroom items as well as the loss of a cloakroom ticket must be reported to the cloakroom staff immediately. Cloakroom items will be returned without a cloakroom ticket only if it is credible that the visitor is the entitled recipient.
§ 12 Lost and found
12.1 Objects of all kinds found in and around the Theatre are to be handed over to the cloakroom staff.
12.2 The loss of objects must be reported to the stage clerk/porter or the cloakroom staff.
§ 13 Liability, damages
13.1 The Theatre assumes no liability whatsoever for property damage or bodily harm, unless the Theatre, its legal representatives or persons employed to perform tasks, acted improperly, deliberately or with gross negligence.
13.2 Claims for damages of customers arising from positive breach of a contractual obligation, from fault arising during conclusion of a contract and unauthorised acts, are excluded, unless the Theatre, its legal representatives or persons employed to perform tasks acted improperly, deliberately or with gross negligence, and essential contractual obligations were violated.
13.3 Claims for damages arising out of the sheer impossibility of performance and default, as well as for a breach of contractual obligations, in case of slight negligence, are limited to the compensation for the foreseeable damage.
13.4 For external services (e.g. catering services), the respective service provider is directly liable, not the Theatre.
§ 14 Data protection
14.1 The Theatre is entitled to process and store the data of the custome, received in the context of the business connection according to the Federal Data Protection Act.
14.2 When ordering on the internet, all data entered by the customer is automatically encrypted (SSL) during the transfer and treated confidentially.
§ 15 Applicable law, place of fulfilment and jurisdiction, severability clause
15.1 German law applies.
15.2 Place of fulfilment and jurisdiction for all claims between the Theatre and customers arising from the business relationship is Munich, Germany, always provided that the customer is a registered merchant, a legal entity or a public entity holding separate fund assets under German law (Sondervermögen).
15.3 Insofar as individual provisions of these general terms and conditions are or become invalid, the validity of the remaining provisions shall remain unaffected thereby. In lieu of any invalid provisions, the customary provision for a case such as the existing one or, in the absence of such customary provision, the respective legal provision shall be deemed agreed.
