General Terms and Conditions of the Deutsches Theater München
§ 1 Scope of application
1.1 The terms and conditions of use govern legal relationships existing between the Deutsches Theater München Betriebs-GmbH (hereinafter referred to as the “Theatre”) and the individual customers, resellers, companies and groups of clients (hereinafter referred to as “customers”). For legal transactions between the Theatre and customers, only the following general terms and conditions of business (hereinafter referred to as “GTC”) shall apply in their current version. Any divergent terms and conditions are not accepted by the Theatre, unless expressly authorised.
1.2 Resellers undertake to disclose the following terms and conditions of use to each purchaser of a ticket.
§ 2 Contract conclusion, ticket purchase, booking and delivery details
2.1 Ticket sales transactions between the Theatre and the visitor are concluded by the order of the customer and the acceptance thereof by the Theatre. Tickets can be purchased at the Theatre box office, associated ticket offices, as well as in writing, by telephone or on the internet. If the order is made in writing, by telephone or on the internet, the customer receives a booking number, which is disclosed verbally, by telephone or in writing.
2.2 In the ball season, the Theatre – with the exception of private events – acts solely and exclusively as a pre-sales point for third-party organisers. Therefore, direct contractual relations with regard to the event arise only between the respective organiser and the customer.
2.3 Right of revocation
You have the right to revoke the contract for the purchase of the voucher(s) or goods without giving any reasons within 14 days.
The period of revocation is 14 days from the date on which you or a third party named by you, who is not the promoter, comes into possession of the voucher(s) or goods.
In order to exercise your right of revocation, you must contact us at: Deutsches Theater München Betriebs-GmbH, Schwanthalerstraße 13 Aufgang II, 80336 Munich, Tel. (089) 55 234-0, Fax +49 (0) 89 55 234-101, Email: firstname.lastname@example.org, by means of a clear statement (e.g. a letter, fax or email) about your decision to revoke this contract. If you make use of this option, we will immediately (e.g. by email) send you a confirmation of the receipt of such a revocation.
In order to adhere to the revocation period, it is sufficient if you send the notification for the right of revocation before the end of the revocation period.
Consequences of revocation
If you revoke this agreement, we are obligated to reimburse you for all payments which we have received from you, including the cost of delivery (except for additional costs resulting from your having chosen a different type of delivery than the standard delivery offered by us) immediately and no later than within a period of 14 days from the date on which the notice of revocation of the contract is received by us. For such a refund, we will use the same means of payment that you used in the original transaction, unless we have expressly agreed otherwise; in no case will you be charged any refund fees. We can decline the refund until we have received the voucher(s) or goods, or until you have provided proof that you have returned the voucher(s) or goods, whichever occurs first. You must return the voucher(s) or goods immediately and in all cases within 14 days from the day on which you informed us about the revocation of this contract. The deadline is deemed observed if you send the voucher(s) or goods before the 14-day deadline. You pay only the direct costs of the return of the voucher(s) or goods. You have to pay for a possible loss of value of the voucher(s) or goods only if this loss in value is attributable to handling such voucher(s) or goods beyond the extent necessary, for checking their condition, properties or features, and functionality.
2.4 If tickets are resold to a third party by the customer, it is expressly agreed that this resale is not effected in the name or by order of the Theatre. Any representation by the Theatre shall be excluded in this context.
2.5 Unless otherwise agreed, tickets will be sent to the customer at his own risk by post after full payment. The purchase price including all fees will be communicated to the customer verbally, by telephone, in writing or by email.
2.6 In the case of telephone, written or group-sale orders, the Theatre is entitled to charge a processing fee. This fee also applies when tickets are collected in person. For orders placed on the internet, the Theatre is entitled to charge an internet fee. Processing and internet charges include the postage costs and must be paid together with the purchase price.
2.7 If the customer has been granted the option of purchasing tickets, this is forfeited without compensation if the customer fails to do so within the agreed deadline.
2.8 Tickets which have been left at the box office must be collected at least 30 minutes before show time.
2.9 Once you have left the venue, the ticket loses its validity.
2.10 Please note that a Print@home ticket is only printable once and cannot be duplicated or altered. In the event that copies of this Print@home ticket are made, only the owner who first appears at the entrance will be admitted to the event. Furthermore, the Theatre reserves the right to demand payment of the total value of the duplicated Print@home tickets from the ticket purchaser whose ticket was illegally duplicated because of his fault.
The Theatre assumes no responsible in the case of loss and/or misuse of the ticket.
§ 3 General information on ticket sales on the internet
3.1 The entire internet web shop, including fulfilment and payment processing, is provided by the company München Ticket GmbH, Seidlstr. 30, 80335 Munich, in the name and account of the Theatre. A contractual relationship arises exclusively between the ticket buyer and the Theatre.
3.2 The ticket buyer has to register in order to purchase tickets for the Theatre on the internet. The ticket purchaser chooses his password himself. The password and other customer data can be changed at any time in the customer’s account by the ticket purchaser. The Theatre recommends changing the password at regular intervals.
The ticket buyer is responsible for ensuring that no unauthorised third parties know his password. The ticket purchaser is liable for any culpable misuse caused by him.
3.3 The ordering procedure is as follows:
3.3.1 Before or after registration, the ticket purchaser can manually select the desired seating places, if they are still available, by means of a so-called “best place option” (the best available places are recommended by the system) or by referring to the seating plan.
If reduced prices are offered, and the ticket purchaser fulfils the prerequisites, a discounted price can then be chosen.
3.3.2 Subsequently, the ticket buyer can choose the desired type of delivery (dispatch by post, collection or Print@home) and payment method.
3.3.3 After the ticket buyer has accepted the general terms and conditions, the purchase order is displayed again and must be confirmed. It is possible to change any and all data here again.
3.3.4 After confirmation of the data, confirmation of the order will be sent to the ticket buyer by email, to the email address specified by him.
3.3.5 Ticket purchases on the internet are limited to 19 tickets per ordering process. The Theatre reserves the right to adjust the number of tickets for each event. The Theatre also reserves the right to restrict the number of tickets available for each ticket purchaser and to cancel any additional orders of individual ticket buyers.
§ 4 Due date and payment, reservation of ownership, default
4.1 Upon assignment of an individual booking number received after purchase, the indicated price is payable. Unless otherwise agreed, payments can be made by transfer, direct debit, cash or credit card.
4.2 Tickets remain the property of the Theatre until payment has been made in full. Should a payment be re-debited, the customer is obligated to return the tickets immediately and to reimburse the costs resulting from the re-debit. Booked tickets which are not paid on time will be released for sale again after the payment period has expired.
4.3 In the event of default in payment, the Theatre is entitled to charge interest of 5% p.a. above the respective base interest rate of the German Central Bank (Deutsche Bundesbank), always provided that the Theatre does not give proof that it is charged with a higher interest rate or the customer gives proof that he is charged with a lower interest rate. The assertion of further damage claims is not excluded hereby.
§ 5 Opening, entry
5.1 The Theatre usually opens one hour before the performance begins.
5.2 After the performance has begun, visitors are only allowed into the auditorium during intermissions, out of consideration for the artists/performers and the other visitors.
5.3 There is no entitlement to an intermission.
§ 6 Changes of cast members/performance times
The Theatre reserves the right to change the announced cast of the roles, as well as the performance times for compelling reasons.
§ 7 Return and exchange of tickets – ticket loss
7.1 A return or the exchange of tickets is basically excluded.
7.2 In the event that a performance is cancelled, the Theatre offers the customer the option of exchange for an equivalent ticket for another performance of his choice within the same performance series, or reimbursement of the purchase price upon return of the entrance ticket. The customer must communicate his preferred option to the Theatre immediately, at the latest within five working days after the cancelled performance. Otherwise, the claim expires. Any further claims on the part of the customer (e.g. travel/accommodation costs) are excluded.
7.3 In the case of a cancellation, the entrance fee will be refunded only if half of the performance has not yet been completed. A claim for reimbursement shall be communicated to the Theatre in writing within five days at the latest.
7.4 It is not permissible to take a seat other than the one indicated on the entrance ticket. In the case of unauthorised place changes, the difference in amount may be levied or the visitor removed from the seat or the entire performance.
7.5 Reimbursement of the purchase price or delivery of replacement ticket in case of the loss of tickets is excluded.
7.6 Any repayment of advance booking fees or other fees is the respective reseller’s responsibility.
7.7 The tickets lose their validity after the start of the performance.
§ 8 Reduced entrance fees
8.1 Reduced ticket prices are granted by the Theatre depending on the event series. The reduction in price can be obtained at the Theatre box office or by telephone for advance bookings.
8.2 The Theatre requires a valid entitlement to all discounted tickets before admission. The identity of the beneficiary must be verified by a photo ID. If no verification can be provided, the difference between the reduced ticket and the full ticket price has to be paid. Otherwise admission cannot be granted.
8.3 The simultaneous grant of several discounts per ticket is excluded.
8.4 For reduced tickets, the discount level mentioned on the homepage of the Theatre in the “Reduced ticket” section, as well as the number of tickets mentioned per booker (https://www.deutsches-theater.de/ermaessigungen/) is valid. The owner of the ticket is the booker. If the booker is granted a price advantage on the basis of the ticket, no further price advantage can be added.
8.5 After completion of the booking process, discounts can no longer be considered.
§ 9 Sound, film, photo and video recordings
9.1 At the venue, audio, film, photo and video recordings are prohibited for copyright reasons. Recording equipment and cameras must be surrendered at the cloakroom to be stored for a fee.
9.2 In the case of infringement, the staff are entitled to confiscate recording equipment and cameras and to keep them until the end of the event. Films and recording media of all kinds, on which parts of the performance are recorded, may be confiscated and kept by the organiser. They will be handed over to the owner once he has agreed to the deletion of the recordings.
9.3 On purchasing the ticket, visitors agree to the fact that the Theatre may take photos and makes recordings within the framework of the event and may reproduce and publish these without temporal or spatial restrictions. This consent is given without waiving any claim for compensation.
§ 10 House rules and regulations
10.1 While at the Theatre
Every visitor must behave in such a manner that no other person feels endangered, disabled, harmed, threatened or harassed.
Unauthorised persons are not permitted on the premises. The following are authorised:
1. Persons visiting an event with a valid entrance ticket
2. Persons buying tickets at the day or evening box office
3. People visiting on an organised tour
4. Government agency representatives performing official duties
5. Artists and cast members, with prior registration
6. Suppliers, with prior registration
7. Employees of Deutsches Theater München Betriebs-GmbH
8. Employees of companies working in the same building
Access to the stage, backstage, cloakroom, rehearsal and storage areas is permitted only for persons with a valid ID. Presence on the stage is only permitted as long as it is necessary.
The instructions of the staff must be followed. In the case of non-compliance, a house ban may be issued. Persons who do not leave the premises despite the staff’s instructions to do so, will be charged with trespassing. Persons who have been banned from the house are not allowed to enter the Theatre.
Furthermore, people who are drunk or under the influence of drugs can be denied access despite having a valid ticket or identity card. People who are not dressed appropriately can be denied entry despite having a valid ticket.
Without permission from the Directorship of the Theatre, it is not permitted to do the following on the entire premises:
1. To sell tickets (“black market”)
2. To sell goods, food or beverages
3. To make music
4. To distribute printed material
5. To advertise or ask for collections/donations
6. To film or take photographs
7. To park vehicles
There is a statutory ban on smoking (Art. 2 No. 6 GSG) in all the rooms of the Theatre. Evacuation routes and emergency exits are to be kept free at all times.
Consumption of food and drinks brought from outside the premises is not permitted in the auditorium (foyer incl. lounge, Theatre hall, bar areas, silver hall) and hallways.
Pets are not allowed in the Theatre hall.
Fire authorities require that visitors surrender their belongings at the visitors’ cloakroom. This specifically includes jackets, coats, umbrellas, bags (except handbags), backpacks, prams, large or bulky items of luggage and musical instruments.
The Theatre accepts no liability for personal belongings and valuables that are kept outside of the visitors’ cloakroom. Lost property will be left on the stage entrance.
10.3 Disturbance of the peace (in the Theatre)
Significant violations of the house rules generally lead to a warning and in serious cases to a house ban. These include, in particular:
– Bringing and using drugs
– Bringing and drinking alcohol outside the defined catering areas
– Bringing or using weapons and other dangerous objects
– The threat or commission of physical violence
– Deliberate damage of property
– Swearing at or insulting the staff of the Theatre or staff of other companies working in the same house, or visitors thereof
– Defilement of the house and grounds
10.4 Miscellaneous provisions
For visitors, the general terms and conditions apply.
The events of the Theatre are generally open to children from the age of 6 years and up. Enquiries for changes regarding individual productions are to be made at the Theatre box office or booking offices.
Tenants and business partners must adhere to the concluded contracts.
The house rules apply with immediate effect.
The house rules of the Theatre are publicly announced and must be adhered to at all times. The instructions of the employees of the Theatre, as well as of the attendant entry control services, must be followed.
§ 11 Cloakroom
11.1 Coats, umbrellas, walking sticks, large bags and similar items must be surrendered at the cloakroom for storage at a fee.
11.2 The loss of or damage to cloakroom items as well as the loss of a cloakroom ticket must be reported to the cloakroom staff immediately. Cloakroom items will be returned without a cloakroom ticket only if it is credible that the visitor is the entitled recipient.
§ 12 Lost and found
12.1 Objects of all kinds found in and around the Theatre are to be handed over to the cloakroom staff.
12.2 The loss of objects must be reported to the stage clerk/porter or the cloakroom staff.
§ 13 Liability, damages
13.1 The Theatre assumes no liability whatsoever for property damage or bodily harm, unless the Theatre, its legal representatives or persons employed to perform tasks, acted improperly, deliberately or with gross negligence.
13.2 Claims for damages of customers arising from positive breach of a contractual obligation, from fault arising during conclusion of a contract and unauthorised acts, are excluded, unless the Theatre, its legal representatives or persons employed to perform tasks acted improperly, deliberately or with gross negligence, and essential contractual obligations were violated.
13.3 Claims for damages arising out of the sheer impossibility of performance and default, as well as for a breach of contractual obligations, in case of slight negligence, are limited to the compensation for the foreseeable damage.
13.4 For external services (e.g. catering services), the respective service provider is directly liable, not the Theatre.
§ 14 Data protection
14.1 The Theatre is entitled to process and store the data of the custome, received in the context of the business connection according to the Federal Data Protection Act.
14.2 When ordering on the internet, all data entered by the customer is automatically encrypted (SSL) during the transfer and treated confidentially.
§ 15 Applicable law, place of fulfilment and jurisdiction, severability clause
15.1 German law applies.
15.2 Place of fulfilment and jurisdiction for all claims between the Theatre and customers arising from the business relationship is Munich, Germany, always provided that the customer is a registered merchant, a legal entity or a public entity holding separate fund assets under German law (Sondervermögen).
15.3 Insofar as individual provisions of these general terms and conditions are or become invalid, the validity of the remaining provisions shall remain unaffected thereby. In lieu of any invalid provisions, the customary provision for a case such as the existing one or, in the absence of such customary provision, the respective legal provision shall be deemed agreed.
